GigaXeSIM – Terms and Conditions
For international customers whose confirmed billing country is outside the Republic of Croatia and Singapore

1. Seller and scope
The seller for transactions covered by these Terms is:

These Terms govern purchases and use of digital eSIMs, physical eSIMs, data packages, top-ups, portable routers, modems and related accessories through gigaxesim.com. The confirmed billing country determines the seller. Transactions with a confirmed Croatian or Singapore billing country are not governed by these Terms. For transactions covered by these Terms, Proximus is the contracting seller. General contact: [email protected].
2. Singapore payment-instrument restriction
Transactions under the international GigaXeSIM service are not available where the payment instrument is issued by a financial institution in Singapore. The payment service provider may use the country associated with the card or other electronic payment instrument, together with normal payment-risk checks, to enforce this restriction. GigaXeSIM does not separately verify citizenship for this purpose. A payment may also be refused where reasonably necessary for fraud prevention, sanctions compliance or applicable law.
3. Account and eligibility
A registered account is required. Users must be at least 18 years old or otherwise legally capable of entering into the contract under applicable law. Users are responsible for providing accurate account information, keeping credentials secure and for activity reasonably attributable to their use of the account. Users should notify [email protected] without undue delay if they become aware of unauthorised account access. Authorised payment service providers may carry out payment authentication, fraud-screening and other transaction-risk checks; this does not limit Proximus’s own obligations concerning account and Platform security.
4. Service description
The current digital eSIM service is data-only unless expressly stated otherwise. It does not include traditional mobile voice, SMS, MMS, a conventional mobile number, or emergency calling capability. Future app-based voice and messaging services may be introduced under separate or supplemental terms.
Connectivity is delivered through third-party connectivity providers, roaming partners and local mobile network operators. Proximus may replace an underlying network partner provided that mandatory consumer rights and the material features of the purchased service are respected. A change of partner does not limit any mandatory remedy available where the purchased service cannot be delivered or materially fails to conform to what was offered.
5. Device compatibility
Before purchase, the user must verify that the exact device model supports eSIM, that the device is network-unlocked and that it supports the operating-system and radio-band requirements relevant to the selected service. Compatibility information published by GigaXeSIM or Proximus is intended to assist that check and is based on manufacturer and network information reasonably available at the time. The user remains responsible for device-specific facts within the user’s control, such as the exact model and carrier-lock status, while Proximus remains responsible for materially inaccurate compatibility information that it expressly provides before purchase.
6. Order formation
The user can review and correct order information before purchase. The checkout will clearly indicate the obligation to pay and will present the information and contractual documents required by applicable law before the order is submitted. The contract is formed when Proximus accepts the order and sends electronic confirmation, unless mandatory local law provides otherwise. The electronic confirmation and applicable contractual information will be provided in a form that the user can retain or save where required by law.
7. Prices, taxes and payment
Prices are presented in EUR and include taxes that Proximus is required to collect. The total amount payable to Proximus will be shown before the user confirms the purchase. For physical products, customs duties, import taxes, clearance charges or similar destination-country charges may apply even to low-value goods and may not always be calculable in advance; unless the checkout expressly states otherwise, such charges are the responsibility of the recipient. Payments are handled by authorised payment service providers. A specific payment gateway does not form part of these Terms and may change, subject to applicable law and the Privacy Policy.
8. Digital eSIM delivery
After successful payment confirmation, the digital eSIM installation details and QR code are automatically sent to the email address associated with the order and/or made available through the user account. Delivery will normally occur within approximately one minute after payment confirmation, subject to payment-processing or technical delays. The email and order information can be retained electronically. If the installation details are not received, the user should contact [email protected]. The user must keep activation credentials confidential.
9. Installation, non-transferability and package start
Once successfully installed on a device, a digital eSIM is treated as provisioned to that device and normally cannot be transferred or reinstalled after deletion unless the specific product expressly supports this. Installation alone does not start package validity. Unless stated otherwise, validity begins on the first successful data session recorded by the underlying network partner. These material limitations must also be disclosed with the relevant product before purchase.
Unless a different activation window is displayed for the product, first activation must occur within 45 days of purchase. If activation is not possible because of a verified problem attributable to Proximus, the eSIM profile or an underlying connectivity partner, the user retains the remedies provided in the Refund and Fair Use Policy and any mandatory rights under applicable law.
10. Unlimited plans and fair use
An “Unlimited” label does not necessarily mean unlimited high-speed data. A plan may include a defined high-speed allowance, reduced speed after the allowance, a reset period, reasonable traffic-management measures or other material restrictions. Any defined threshold, reduced speed, reset period or other material fair-use limitation must be clearly disclosed before purchase. Temporary technical traffic-management measures must be applied only where permitted by applicable law and must not be used to contradict the material characteristics disclosed for the purchased plan.
11. Hotspot and tethering
Personal and ordinary business hotspot/tethering is allowed unless a specific package clearly states otherwise before purchase. Without written approval, the service may not be used as a public Wi-Fi service, a data-centre or server-hosting connection, a SIM/eSIM farm, a mass IoT gateway, a permanent resale connection or another comparable large-scale commercial use that materially departs from normal end-user connectivity. Any package-specific restriction that may affect ordinary tethering must be disclosed before purchase.
12. Coverage, speed and availability
Actual service depends on location, local network coverage, device capability, congestion, maintenance, regulation and other technical conditions. 4G/5G labels describe technologies that may be available and do not guarantee a specific speed or continuous availability at every location. This does not override material product information expressly provided before purchase. If the purchased data service cannot be used because of a verified problem attributable to Proximus or an underlying connectivity partner and reasonable troubleshooting does not restore the service, Proximus will provide an appropriate remedy, which may include a replacement service or a refund proportionate to the unused part of the purchased package, without limiting any greater mandatory rights under applicable law.
13. Prohibited use
· fraud or attempted fraud;
· unauthorised resale of connectivity;
· SIM/eSIM farming, meaning organised use of multiple profiles primarily to generate, aggregate or resell traffic, or artificial traffic generation;
· network attacks, distribution of malware or unauthorised access;
· circumvention of clearly disclosed fair-use, package or security controls;
· cloning, tampering with or unauthorised modification of an eSIM profile;
· commercial scraping, automated price extraction or bot activity that materially interferes with the Platform or is undertaken for unauthorised commercial exploitation;
· use contrary to applicable law or third-party rights.
14. Suspension and termination
Proximus may temporarily suspend an account or service where reasonably necessary to address suspected fraud, a material security risk, unlawful use, sanctions, a binding regulatory requirement or another urgent risk to the Platform or service. Where the issue is not urgent, Proximus may also suspend service for a serious or repeated breach of these Terms, materially false account information, demonstrably abusive payment disputes or a partner restriction that makes continued provision of the purchased service impossible or unlawful. Where practicable and lawful, the user will be informed of the reason and given a reasonable opportunity to clarify or remedy the issue before permanent termination. Permanent termination will be used only where proportionate to a serious or repeated breach, required by law, or where the service can no longer lawfully or technically be provided. If service is permanently terminated for a reason not attributable to the user, Proximus will refund the unused portion of any prepaid package where appropriate, without limiting mandatory consumer rights.
15. Refunds and cancellation
Refund and cancellation rules are set out in the separate Refund and Fair Use Policy, which forms part of the contractual documentation for relevant purchases. Nothing in these Terms or that Policy excludes mandatory consumer rights that cannot lawfully be waived.
16. Physical eSIMs, routers, modems and accessories
Physical eSIMs, routers, modems and accessories are subject to the delivery options, charges and estimated delivery times shown before purchase. For international deliveries, customs duties, import taxes, clearance fees or similar charges may be imposed by the destination country; unless expressly included at checkout, such charges are borne by the recipient. Risk, title and delivery obligations are determined in accordance with applicable mandatory law. If delivery fails for a reason attributable to Proximus or its delivery provider, the user retains the applicable right to replacement, refund or other remedy.
Where applicable law gives a consumer a statutory right to withdraw from a distance purchase of physical goods, that right and the applicable return period will be respected. The user may be responsible for the direct cost of return where the law permits and the user was informed of that cost before purchase. Defective, damaged, misdescribed or non-conforming goods are handled in accordance with applicable mandatory conformity and warranty rules. Any activated or personalised communications service is assessed separately from rights relating to the physical medium or equipment.
17. Support and complaints
All customer communications, including technical support requests, complaints, privacy enquiries and legal notices, may be sent to [email protected]. The address is actively monitored for the international GigaXeSIM service. Users should include the order number and information reasonably necessary to identify the relevant purchase or issue. Proximus will acknowledge and handle complaints and statutory requests within the time limits required by applicable law.
18. Privacy and cookies
Proximus is the controller for customers covered by these Terms. DIGICOM d.o.o. may access international customer data solely as an operational service provider/data processor for Proximus in connection with administration and support of the GigaXeSIM Platform and does not use those data for its own marketing or independent purposes. Payment service providers and connectivity partners process only the data necessary for their respective functions, as further described in the Privacy Policy. The Platform may use strictly necessary technical cookies or similar storage required for operation, login, checkout and security. Proximus does not currently use non-essential analytics or advertising cookies for the international service; if such technologies are introduced, they will be used only in accordance with applicable law and, where required, after consent.
19. Business customers and authorised resellers
Resale is permitted only to authorised business partners under a written reseller or distribution agreement. Such partners may buy services for employees or other approved end users in accordance with that agreement. DIGICOM d.o.o. acts as Proximus’s exclusive distributor for the territory of the Republic of Croatia, where customer transactions are governed by separate Croatian terms and DIGICOM assumes the relevant obligations toward Croatian customers. For other B2B relationships, the applicable reseller or distribution agreement prevails over these Terms to the extent of any conflict, without reducing mandatory rights of any end consumer where those rights apply.
20. Intellectual property and platform protection
GigaX and GigaXeSIM names, Platform design, databases, software and other protected materials are owned by or licensed to Proximus and/or the relevant right holders, including the applicable brand owner and licensors. They may not be copied, modified, scraped, reverse engineered or commercially exploited without written permission, except to the extent mandatory law expressly permits.
21. Liability
To the maximum extent permitted by applicable law, Proximus is not liable for indirect, incidental or consequential loss that was not reasonably foreseeable as a result of the relevant breach, or for loss caused solely by events genuinely outside its reasonable control, including force majeure, binding regulatory restrictions or failures of infrastructure that Proximus could not reasonably prevent or overcome. Local-network or upstream-partner failures do not automatically exclude the user’s contractual remedies where the purchased service is not provided or materially fails to conform to what was sold. If a verified service failure attributable to Proximus or an underlying partner prevents use of the purchased data package and cannot be reasonably remedied, Proximus will refund the amount proportionate to the unused part of the package, without limiting any greater mandatory right to refund, compensation or other remedy. Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited, including liability for death or personal injury caused by negligence where applicable law so provides, or liability arising from fraud, wilful misconduct or other conduct for which exclusion is prohibited.
22. Governing law and consumer safeguards
These Terms are governed by Singapore law, except where mandatory consumer-protection rules applicable to a user cannot be displaced by contractual choice of law. For consumers, any jurisdiction clause is subject to mandatory rules that give the consumer the right to bring or defend proceedings elsewhere.
23. B2B disputes
Unless a separate written agreement provides otherwise, Proximus and a business customer will first attempt in good faith to resolve any dispute through direct negotiation. If the dispute is not resolved within 30 days after written notice of the dispute, either party may bring proceedings before the courts of Singapore. A separate reseller, distribution or other B2B agreement may instead provide for arbitration, including arbitration under the Singapore International Arbitration Centre (SIAC) Rules, and any such specific dispute-resolution clause will prevail.
24. Changes and severability
Updated Terms may be published on the Platform and will apply to future purchases from the stated effective date. A new version will not retroactively remove rights already accrued under a completed purchase. Where a purchased package remains unactivated, active or otherwise subject to future performance, Proximus will not materially reduce its contracted features through a Terms update unless the change is reasonably necessary because of law, security, a competent authority or another valid reason expressly permitted by applicable law. Where a material change adversely affects an existing package, the user will be informed where required and will retain any applicable right to cancel, receive a refund for the affected unused portion or exercise another mandatory remedy. If any provision is unenforceable, the remaining provisions remain effective to the fullest extent permitted by law.
